The Volte UK operates a strict zero-tolerance policy regarding theft and non-return of rented items. All users agree to this policy as part of our Terms of Service.
Definition of Theft
- Any rented item not returned within 14 days after the agreed rental end date, without prior contact, communication, or valid explanation provided by the Borrower, will be classified as stolen.
- This timeframe includes any grace periods that may apply but excludes documented shipping delays, force majeure events, or circumstances where the Borrower has proactively contacted The Volte UK or the Lender to notify of exceptional circumstances.
Action Upon Theft
Where an item is deemed stolen:
- The Volte UK will take all reasonable steps to recover the item and/or the full Replacement Value of the item from the Borrower.
- The Volte UK may initiate formal debt recovery proceedings against the Borrower, which may include:
- Charging the payment method on file.
- Engaging third-party debt recovery agencies.
- Initiating legal action, including but not limited to County Court Claims in the UK.
- Reporting the theft to relevant law enforcement authorities.
Borrower Liability
- The Borrower will be fully liable for:
- The full replacement cost of the item.
- Any additional legal, recovery, administrative, or court fees incurred in pursuing recovery.
- Interest on outstanding amounts, where applicable, as permitted under UK law.
Borrower Responsibilities
To avoid escalation, Borrowers must:
- Ensure timely return of items within the rental period.
- Immediately notify The Volte UK and the Lender if unforeseen delays occur.
- Cooperate fully in returning items or resolving any outstanding issues.
Lender Protection
The Volte UK will actively assist Lenders in pursuing recovery where theft has occurred, although The Volte UK cannot guarantee successful recovery. In such cases, The Volte UK will liaise with Lenders regarding next steps in accordance with applicable laws and our platform’s terms.
Legal Notice
Theft of rental property is a criminal offence under the Theft Act 1968 (UK). The Volte UK reserves the right to report suspected theft to law enforcement authorities.
This Theft Policy forms part of The Volte UK’s Terms of Service and is binding on all Members.
